Kratom Legality In Texas: Can You Buy Kratom In Texas?

Kratom is emerging as a miraculous herbal plant that is changing lives with its numerous health benefits all around the globe. Although it’s been around for many decades in its originating Southeast Asian countries like Thailand, Indonesia, etc., the Western world has discovered its wondrous uses not many years ago. This is why there are many dubious concepts, myths, and misinformation surrounding this botanical, making it hard for government bodies to allow its free legal usage.

Thankfully, Kratom is completely legal on a federal level. However, several states have independently put bans or restrictions on its usage. In Texas, there is also no complete freedom to use this herb as you want. If you are a resident of Texas or traveling to the Lone Star State, Kratom’s legality in Texas must be a subject of concern for you.

Well, worry no more!

In this article, we will be answering all of your related queries.

Is Kratom Legal In Texas?

Yes, although Kratom is legal in the Lone Star State, there are some regulatory restrictions on its usage within the state borders. You can freely manufacture, buy, sell, distribute, or market Kratom products, as long as you are older than 18 years of age.

In Sept 2023, the Texas Kratom Consumer Health and Safety Protection Act was passed that regulated the botanical use to better protect consumers against any adulterated or impure Kratom products.

This law also punishes any exploitative vendors that are mislabeling or marketing their products in a false way, predating the users. The state government also set an age limit for its usage to allow mature decision-making of users and avoid minors getting their hands on this herbal supplement.

Texas Kratom Consumer Protection Act

Texas Kratom Consumer Health And Safety Protection Act (House Bill- 861), proposing regulatory guidelines for safe Kratom usage, was passed in 2023 to make it a part of the legislation of the state.

The main points proposed in the KCPA version of Texas are:

  • Kratom can not be sold or distributed to anyone less than 18 years of age.
  • Kratom vendors should properly label the products with directions for usage for consumer safety.
  • Serving size should be mentioned on the packaging.
  • Retailers are not allowed to manufacture, distribute, sell, or offer any Kratom product that may be adulterated with a dangerous or controlled substance that can be injurious to health.
  • No Kratom product containing more than 2% HydroxyMitragynine of the alkaloid composition is allowed to be manufactured or sold.
  • Kratom products containing synthetic alkaloids or any synthetically derived compound from Mitragyna plants are also prohibited.

What Is The Penalty For Not Abiding By The Kratom Law In Texas?

The Texas state government has severe penalties in place for anyone who fails to abide by the Kratom law. Anyone who violates any section of the KCPA is liable to Class C misdemeanor offense, in which the civil penalty charged is in the amount of:

  • $250 for the first violation.
  • $500 for the second violation.
  • $1000 for each subsequent violation.

Moreover, a separate penalty is charged for each day the violation continues. If a Kratom vendor proves that the violation –except that of selling to a minor–  is unintentional or “due to its good faith reliance on the representation of another processor”, the civil penalty can be waived off.

Legislative History Of Kratom In Texas

Although Kratom is regulated in the state of Texas today for better consumer safety, it was not always the case. In the start, Kratom was legal by default as there were no specific laws pertaining to the botanical in Texas. It wasn’t until 2021, that lawmakers started taking notice of it looking at the huge popularity of this natural herb.

In the past, many legislative propositions have been made to make positive changes in the law to regulate Kratom for the betterment of consumers.

HB- 1097 And SB- 821

House Bill 1097 and Senate Bill 821, proposed in Sept 2021 consecutively a few days apart only, were the first legislations in Texas to suggest regulatory guidelines for users and sellers alike. Although they failed to get enough momentum in the assembly to become law soon after, had they been accepted it would have made KCPA possible way before it was originally sanctioned.

It proposed the same guideline framework as the original Kratom Act enacted today. However, despite the consumer-oriented legislative regulation, Texas’s libertarian stance on supplement usage prompted them to avoid putting any restrictions on its usage.

HB- 861 And SB- 497

After this, Senate Bill 497 was introduced by a Texan senator named Judith Zaffirani in Sept, 2023, seeking the manufacturing, processing, packaging, distribution, and trade of Kratom products ethical and consumer friendly. It also provided civil penalties that made violation of Kratom laws a criminal offense. The senator tweeted regarding her efforts to regulate the botanical,

“My intent in filing this bill was to make regulated, safe Kratom products available to those needing them while discouraging illegal distribution and use.”

This was reinforced by the proposition and approval of House Bill 861, introduced by state representative J.M Lozano, around the same time, which is the current KCHSPA (Texas version of KCPA). Making these regulatory guidelines a part of the legislation has made it safer for users to purchase only pure and unadulterated Kratom.

What Does The Future Of Kratom In Texas Look Like?

As Kratom is currently regulated under KCPA and safe to use for consumers, there doesn’t seem to be any major legal changes that can be enacted in the Texan Kratom law for now or in the near future.

If the vendors and users both keep practicing the safety guidelines to use Kratom products responsibly, there shouldn’t be any need for the state officials to take any further action in this matter.

Moreover, education and further studies on Kratom use and its potential risks is also essential to bust any myths or stigma attached to this beneficial botanical usage. For users, we have only one advice:

Keep standing for balanced and healthy policies and always follow what’s right!

As Kratom supporters and advocates to resolve the stigma and misinformation surrounding this botanical, it is our utmost duty to follow these regulations by heart and never try to cut corners.

For consumer safety, vendors should also abide by the law in following all the regulations pertaining to a transparent manufacturing process, appropriate labeling, ethical marketing, and safe packaging.
